G-20 Protestor Faces Felony Charge

Dozens of arrested G-20 protestors are scheduled to appear in City Court Wednesday morning.

They include 21-year-old David Japenga, from California, who police say single-handedly caused thousands of dollars worth of damage.

Police say he paraded up Craig Street in Oakland last Thursday, wielding a metal chain with a heavy lock on the end and smashed nearly two dozen windows along the way at places including Quizno's and Citizens Bank.

"He actually broke approximately 20 different windows and doors during his escapade," Pittsburgh Police Chief Nate Harper said.

Unlike the other protestors, police have charged Japenga with a felony count of criminal mischief which could result in significant jail time.

He has been held without bail at the Allegheny County Jail.

On the internet, anarchist groups say Japenga is being unfairly singled out and have called on people to pack the courtroom Wednesday.

Patrick Nightingale, an attorney for Japenga, says he'll vigorously fight the charges and adds that police will have a difficult time pinning all that damage on his client.

"For all I know, ... the evidence that we'll have tomorrow is a police officer or a witness saying someone clad in black with a black mask committed damage and my client happened to be clad in black at the time that he was arrested," he said.

In addition to Japenga, 51 others face hearings which promise to be an all-day affair.

But unlike Japenga, most should be free to go after paying a fine.

The plaza in front of municipal court could be packed Wednesday with protestors accused of crimes and their supporters.
