2 Years later

…and still no end of the repression

2 years after the protests against the NATO summit in Strasbourg a new trial against a former arrested person is going to begin. After 4 months in jail, Jan was acquitted by the appeal court in Colmar. Shortly after the verdict, the chief prosecutor appealed. After this was accepted by the Paris court of appeal, the process will be reopened.

The charges made by the french state still remain: carrying a weapon of the 6th category and being part of an unlawful assembly. Also the prosecutors are going to try to construct a membership of the so called “Black Bloc”. Jan threaten up to three years detention without probation again.

Also Matthias got his verdict of his civil process not long ago. Because of his entry ban he couldn´t personally appear to his trial. The amount of the required sum is 6000 euro. With this verdict the court clearly differs from the first claims of the plaintiff. At the beginning of the trial, the plaintiff wanted to have around 30000 euro. Given that the concerned police officer fell during the detention without the assistance of Matthias, this verdict is a cheek.

Philip still aims for an appeal procedure to obtain an acquittal.

The trial of Jan will happen on the 9th march at 01:30 pm in Nancy. Because of this, we are calling for diverse, decentralized solidarity actions on this day. There is going to be a rally in Nancy in front of the courthouse. On this occasion there is going to be a bus, which presumably starts in Berlin and is going to pass Dresden, Strasbourg and Nancy. The bus starts in Berlin on the 8th march at 20:00. The return journey, which depends on the length of the trial, is going to be on the trial day.

2 Jahre danach…

…und immer noch kein Ende der Repression

Zwei Jahre nach den Protesten gegen den NATO-Gipfel im französischen Strasbourg kommt es nun erneut zu einem Verfahren gegen einen der ehemaligen Inhaftierten. Jan ist nach 4 Monaten Haft vor dem Berufungsgericht in Colmar freigesprochen worden. Kurz nach diesem Urteil ging der Oberstaatsanwalt in Revision. Nach dem dieser durch das Pariser Revisionsgericht stattgegeben wurde, wird der Prozess neu aufgerollt.

Die durch den französischen Staat erhobenen Anklagepunkte bleiben dabei erhalten, das tragen einer Waffe der 6. Kategorie (Eisenstange) und die Anteilnahme an einer nicht genehmigten Zusammenrottung. Darüber hinaus wird die Staatsanwaltschaft mit großer Wahrscheinlichkeit erneut versuchen eine Zugehörigkeit zum sog. Black Bloc zu konstruieren. Jan drohen erneut bis zu drei Jahre Haft ohne Bewährung.
Auch Matthias hat vor kurzem das Urteil seines zivilrechtlichen Prozesses erhalten. Aufgrund seines Einreiseverbotes konnte er zu dem Verfahren nicht persönlich erscheinen. Die Höhe der geforderten Summe beträgt 6000 Euro. Damit weicht das Gericht in seinem Urteil deutlich von der ersten Forderung des Klägers ab. Dieser wollte zu Beginn des Prozesses ca. 30.000 Euro erstreiten. Angesichts der Tatsache, dass der betroffene Beamte bei der Verhaftung ohne Matthias Zutun stürtzte, ist dieses Urteil eine Frechheit (siehe Zusammenfassung).
Phillip strebt nach wie vor ein Revisionsverfahren an, um einen Freispruch zu erwirken.
Jans Verhandlung findet am 9. März 13:30 Uhr in Nancy statt. Aus diesem Grund rufen wir zu vielfältigen, dezentralen Soliaktionen an diesem Tag auf. In Nancy selbst, wird es eine Kundgebung vor dem Gerichtsgebäude geben. Aus diesem Anlass gibt es einen Bus der vorraussichtlich von Berlin über Dresden und Strasbourg nach Nancy fährt. Start in Berlin ist der 08.März 20:00 Uhr. Die Rückreise erfolgt abhängig von der Dauer des Prozesses zwischen 17:00 und 20:00 Uhr am Verhandlungstag.

…et la répression continue

Deux ans après les manifestations anti-OTAN à Strasbourg, un nouveau procès contre un ancien détenue est annoncé. Jan, qui avait été relaxé par la cour d’appel de Colmar après avoir passé 4 mois en maison d’arrêt,doit comparaitre à nouveau; le procureur général ayant fait un pourvoi en cassation peu de temps après le jugement. La Cour de Cassation de Paris a finalement cassé la décision et renvoyé l’affaire devant une nouvelle juridiction.

Les accusations portées par l’État française sont maintenues: port d’une arme de 6ème catégorie (barre de fer) et participation à un attroupement. Par ailleurs il est très probable que le parquet va essayer à nouveau d’établir une appartenance au «black bloc». Jan risque une peine de trois ans fermes.

Matthias, un autre ex-détenue, vient d’avoir le jugement suite à la dernière audience en civile. A cause de son interdiction de territoire, il n’ pas pu assister à l’audience. Le montant réclamé est de 6000 Euros; durant l’audience précédente, les parties civiles avaient essayées d’obtenir environ 30 000 Euros ! Étant donné que le fonctionnaire concerné était tombé par sa propre faute, ce jugement paraît insolent.

Philipp, également incarcéré pendant 4 mois suite au contre-sommet de l’OTAN, est toujours en attente de son procès en cassation pour obtenir la relaxe.

Le procès contre Jan aura lieu à Nancy le 9 mars à 13:30 ; à cet occasion, nous appelons à lancer toutes sortes d’actions décentralisées en soutien ce jour là. A Nancy il y aura un rassemblement devant le tribunal. Nous organisons un bus vers Nancy qui partira probablement de Berlin en passant par Dresde et Strasbourg. Le départ aura lieu à Berlin le 8 mars vers 20 h, le retour en fonction de la durée de l’audience entre 17 h et 20 h le jour même.
